COURT UPHOLDS COUNTY’S DEMURRER ON CEQA CASE

CITIZENS FOR CHIQUITA CANYON CLOSURE v. COUNTY OF LOS ANGELES (CEQA CASE)

On September 30, 2024, the Court declined to let Petitioners Citizens for Chiquita Canyon Closure challenge the County’s decision to permit the landfill to continue taking in trash and processing hazardous waste onsite without any CEQA analysis. The court’s analysis failed to enforce the CEQA analysis to find less harmful or mitigation measures.

The Court recognized during the hearing that the operations at issue, including processing hazardous waste would have a significant impact on the environment.

Based on the Court’s recognition that current actions are having a significant impact on the environment and the surrounding community, we were disappointed to see that the court did not allow the case to continue and be heard on the merits.
